El debido proceso, su observancia en la Ley Procesal Penal Militar

Resumen

El presente trabajo fue realizado bajo el Título “El debido proceso, su cumplimiento en el Proceso Penal Militar”, siguió el hilo conductor que permitió valorar la Ley de Procedimiento Penal Militar, teniendo en cuenta el cumplimiento de los Principios del Debido Proceso. Para estructurar el presente artículo inicialmente se realizó una valoración acerca del “debido proceso penal y su relación con la Ley Procesal Penal Militar”, y posteriormente se procedió a la “identificación de los principios del debido proceso”. Consideramos que nuestro modesto aporte servirá para estudios futuros que podrán ser enriquecidos en la medida del continuo desarrollo de la práctica jurídica en el Procedimiento Penal Militar. El logro del objetivo trazado fue cumplido mediante la utilización del método de consulta a fuentes bibliográficas. Como aporte teórico sistematizamos teóricamente el Debido Proceso, siendo identificados sus principios básicos en la Ley Procesal Penal Militar.

ABSTRACT

The present work was carried out under the Title "the due process, its execution in the military penal process", it followed the conductive thread that allowed to value the Law of Military Penal Procedure, keeping in mind the execution of the Principles of the Due Process. To structure the present article initially he/she was carried out a valuation about the "due penal process and their relationship with the law procedural military prison", and later on you proceeded to the "identification of the principles of the due process". We consider that our modest contribution will be good for future studies that you/they will be able to be enriched in the measure of the continuous development of the artificial practice in the Military Penal Procedure. The achievement of the objective layout was completed by means of the use from the consultation method to bibliographical sources. As theoretical contribution we systematize the Due Process theoretically, being identified their basic principles in the Law Procedural Military Prison.
