La legislación archivística en su insoslayable importancia: su historia en Cuba
Resumen
Los documentos son la fiel evidencia de los actos y trámites jurídicos. Desde la colonia se proclamaron disposiciones jurídicas encaminadas a proteger este preciado bien jurídico, en el entendido de que su posesión y acceso entrañaba un valor económico y un poder social en última instancia. La historia de este tránsito legislativo impera por su importancia y relevancia para los países del área Iberoamericana, llegando a influir en algunos casos en sus valores identitarios. Se ilustra esta afirmación con el caso Cuba, que cuenta con una importante y sólida tradición legislativa en materia de protección de los documentos y el funcionamiento de sus archivos. Esta contribución tiene el objetivo de analizar integralmente la historia legislativa en archivos de Cuba, a partir de una fundamentación holística del tema y de los parámetros que fundamentan su propuesta. Para lograr ese objetivo se emplearon los métodos científicos siguientes: análisis histórico-jurídico, análisis teórico-jurídico; análisis jurídico-comparativo. Se ofrece un estudio integral y holístico de la historia de este particular en Cuba con una fuerte fundamentación de su importancia. Estas valoraciones, además, dan una mirada multidisciplinaria al tema donde fecundan herramientas de la Ciencias Históricas, Jurídicas y la Archivística.

ABSTRACT
The documents are the faithful evidence of the legal acts and procedures. From the colony, legal provisions were proclaimed aimed at protecting this precious legal asset, with the understanding that its possession and access implied an economic value and social power in the last instance. The history of this legislative transit prevails due to its importance and relevance for the countries of the Ibero-American area, influencing in some cases their identity values. This affirmation is illustrated with the case of Cuba, which has an important and solid legislative tradition regarding the protection of documents and the operation of its archives. This contribution has the objective of comprehensively analyzing the legislative history in archives of Cuba, based on a holistic foundation of the subject and the parameters that support its proposal. To achieve this objective, the following scientific methods were used: historical-legal analysis, theoretical-legal analysis; legal-comparative analysis. A comprehensive and holistic study of the history of this particular in Cuba is offered with a strong foundation of its importance. These evaluations also give a multidisciplinary look to the subject where tools of Historical, Legal and Archival Sciences.
