Need for a Gender Identity Law in Cuba. Proposal for its elaboration
Abstract
Although the right to decide on gender identity is recognized as a Universal Human Right, trans people continue to be the object of rejection and discrimination because they are not identified according to their gender identity, which makes it necessary to develop laws and regulations that guarantee their rights. For this, different research methods were used, among which are fundamentally: the exegetical-analytical, the doctrinal, the historical-logical and the hermeneutic. Regulations such as the Gender Identity Law are tools that allow trans people to be recognized as subjects of law, respecting their capacity for self-determination, avoiding the pathologization of their experience and proposing a simple procedure for these people to rectify in their oficial documents the change of name and sex according to their self-perceived gender identity.
